Terms of Use & Privacy Policy
These Terms and Conditions ("You", "Your") are provided by BND Hospitality ("Wholebeds", "We", "Us", "Our") to you as a user of the services ("Services") and establish the principles for providing accommodation and hotel revenue management system services.
We may modify the terms of this Agreement at any time by providing you with at least 30 days' prior written notice. Your use of the Services constitutes confirmation that you accept the terms of this Agreement, which may be updated from time to time.
The Services consist of SAAS (Software as a Service) modules and related units, defined as the https://wholebeds.com/ website, the https://app.wholebeds.com/ mobile application, and other digital services/applications offered under the name "Wholebeds."
We will provide the Services under the "Wholebeds Software as a Service (SAAS) Subscription and Licensing Agreement" ("Master Agreement") signed between you and us.
We reserve the right to update, modify, limit, or terminate this document at any time. We will make reasonable efforts to notify you of any significant changes to the Services or this document. Any additional services we may provide will also be included within the scope of the Services and governed by these Terms and Conditions.
You must ensure that all the information you provide is accurate, up-to-date, and complete, and you must inform us of any changes.
We may provide you with a username and password to access the Services. This information is for your use only. You must keep your username and password confidential and not share them with third parties.
You are responsible for all transactions carried out using your username and password. You agree that we will not be held liable for any claims arising from your failure to maintain the security of your username or password.
You must notify us immediately if you detect any unauthorized use or security breaches.
You agree to pay all fees specified in the Master Agreement and its annexes for the Services.
All fees exclude taxes, duties, and other governmental charges, which are your responsibility.
If payment is not made within the due date, we may suspend the Services upon written notice.
We reserve the right to apply late fees on unpaid amounts and recover collection costs, including legal fees.
We reserve the right to change our pricing structure and payment terms from time to time. Changes will be communicated via a notification sent to the email address you have registered or provided to us.
Wholebeds makes no guarantees regarding the suitability of the Services for any particular purpose, their uninterrupted operation, or their adherence to a specific quality standard. The Services are provided "as is."
You acknowledge that the Services are used for commercial purposes and that consumer protection laws may not apply.
We will not be liable for any loss of profit, loss of revenue, loss of data, or any indirect, special, punitive, or incidental damages.
Our liability is limited to the fees you have paid in the past month.
We are not responsible for service interruptions due to internet connectivity, computer systems, or other factors.
It is your responsibility to back up your data.
All intellectual property rights related to the Services and the systems used belong to Wholebeds. You agree not to violate these rights.
You agree to keep confidential information secure and to use it only for fulfilling the requirements of this Agreement.
Wholebeds has the right to promote you as a client. We may use your name and logo in promotional materials.
The Services are not integrated with third-party systems and websites. We are not responsible for the availability or content of these systems.
Wholebeds does not collect or store personal data of your hotel guests. If you collect personal information from your customers, it is your responsibility to store this information securely.
You must always securely store any information provided by Wholebeds.
If you violate these Terms and Conditions or the Master Agreement, we may terminate the Services immediately.
In case of termination:
Assignment and Subcontractors: Wholebeds may transfer its rights and obligations. However, you may not do so without our prior written consent.
Governing Law: This Agreement is subject to the laws of the Republic of Turkey, and the courts of Istanbul shall have jurisdiction.
Waiver: Any delay in enforcing this Agreement does not constitute a waiver of our rights.

Bu Hizmet Şartları ve Koşulları ("Siz", "Sizin"), BND Hospitality ("Wholebeds", "Biz", "Bize", "Bizim") tarafından, hizmetlerimizin ("Hizmetler") kullanıcısı olarak size sunulmakta olup konaklama ve otel gelir yönetim sistemi hizmetlerinin sağlanmasına ilişkin esasları belirler.
Bu Sözleşmenin hükümlerini en az 30 gün önceden yazılı bildirimde bulunmak suretiyle her zaman değiştirebiliriz. Hizmetleri kullanmaya devam etmeniz, zaman zaman güncellenebilecek bu Sözleşmenin koşullarını kabul ettiğinizin teyidi anlamına gelir.
Hizmetler, "Wholebeds" adı altında sunulan SAAS (Software as a Service / Hizmet olarak Yazılım) modülleri ve ilgili birimlerden oluşur; https://wholebeds.com/ web sitesi, https://app.wholebeds.com/ mobil uygulaması ve diğer dijital servisler bu kapsamdadır.
Hizmetler, taraflar arasında imzalanan "Wholebeds Hizmet Olarak Yazılım (SAAS) Abonelik ve Lisans Sözleşmesi" ("Ana Sözleşme") çerçevesinde sunulur.
Bu belgeyi her zaman güncelleme, değiştirme, sınırlama veya sonlandırma hakkını saklı tutarız. Hizmetlerde veya bu belgede yapılacak önemli değişiklikleri size bildirmek için makul çabayı göstereceğiz.
Sağladığınız tüm bilgilerin doğru, güncel ve eksiksiz olmasını sağlamalı, değişiklikleri bize bildirmelisiniz.
Hizmetlere erişim için kullanıcı adı ve şifre tarafımızca sağlanabilir. Bu bilgiler yalnızca sizin kullanımınız içindir; gizli tutulmalı ve üçüncü kişilerle paylaşılmamalıdır.
Kullanıcı adı ve şifrenizle yapılan tüm işlemlerden siz sorumlusunuz. Güvenliği sağlama yükümlülüğünüzü ihlal etmenizden kaynaklanan taleplerden sorumlu tutulmayacağımızı kabul edersiniz.
Yetkisiz kullanım veya güvenlik ihlali tespit etmeniz halinde derhal bizi bilgilendirmelisiniz.
Ana Sözleşme ve eklerinde belirtilen tüm ücretleri ödemeyi kabul edersiniz.
Tüm ücretler vergiler, harçlar ve diğer kamusal yükümlülükler hariçtir; bunlar size aittir.
Vade tarihinde ödeme yapılmazsa, yazılı bildirim ile Hizmetleri askıya alabiliriz.
Ödenmemiş tutarlara gecikme faizi uygulama ve hukuki masraflar dahil tahsilat masraflarını talep etme hakkımızı saklı tutarız.
Fiyatlandırma yapımızı ve ödeme koşullarını zaman zaman değiştirme hakkını saklı tutarız. Değişiklikler kayıtlı e-posta adresinize bildirim gönderilerek duyurulur.
Wholebeds, Hizmetlerin belirli bir amaca uygunluğu, kesintisiz çalışması veya belirli bir kalite standardına uyması konusunda garanti vermez. Hizmetler "olduğu gibi" sunulur.
Hizmetlerin ticari amaçlarla kullanıldığını ve tüketici koruma mevzuatının uygulanmayabileceğini kabul edersiniz.
Kar kaybı, gelir kaybı, veri kaybı veya dolaylı, özel, cezai ya da arızi zararlardan sorumlu olmayız.
Sorumluluğumuz son bir ayda ödediğiniz ücretlerle sınırlıdır.
İnternet bağlantısı, bilgisayar sistemleri veya diğer faktörler nedeniyle oluşan kesintilerden sorumlu değiliz.
Verilerinizin yedeklenmesi sizin sorumluluğunuzdadır.
Hizmetlere ve kullanılan sistemlere ilişkin tüm fikri mülkiyet hakları Wholebeds'e aittir. Bu hakları ihlal etmemeyi kabul edersiniz.
Gizli bilgileri güvende tutmayı ve yalnızca bu Sözleşmenin gerekliliklerini yerine getirmek için kullanmayı kabul edersiniz.
Wholebeds sizi müşteri olarak tanıtma hakkına sahiptir. Adınızı ve logonuzu tanıtım materyallerinde kullanabiliriz.
Hizmetler üçüncü taraf sistem ve web siteleriyle entegre değildir. Bu sistemlerin erişilebilirliği veya içeriğinden sorumlu değiliz.
Wholebeds, otel misafirlerinizin kişisel verilerini toplamaz veya saklamaz. Müşterilerinizden kişisel bilgi topluyorsanız, bunları güvenli şekilde saklamak sizin sorumluluğunuzdadır.
Wholebeds tarafından sağlanan bilgileri her zaman güvenli şekilde saklamalısınız.
Bu Şartları veya Ana Sözleşmeyi ihlal etmeniz halinde Hizmetleri derhal sonlandırabiliriz.
Fesih halinde:
Devir ve Alt Yükleniciler: Wholebeds hak ve yükümlülüklerini devredebilir. Ancak siz, ön yazılı onayımız olmadan devir yapamazsınız.
Uygulanacak Hukuk: Bu Sözleşme Türkiye Cumhuriyeti hukukuna tabidir; İstanbul mahkemeleri yetkilidir.
Feragat: Bu Sözleşmenin uygulanmasındaki herhangi bir gecikme, haklarımızdan feragat ettiğimiz anlamına gelmez.

This Privacy Policy describes how BND Hospitality ("Wholebeds", "We") collects, uses, and protects information when you use the Wholebeds RevenueOS platform (the "Services").
BND Hospitality, registered in Türkiye, acts as the data controller for the personal data of your authorized users (admins, revenue managers) who log in to the platform. For data about your hotel's guests that you process through the Services, you are the data controller and Wholebeds acts as a data processor.
Processing is based on: (a) performance of the contract between you and Wholebeds; (b) our legitimate interests in operating and securing the Services; (c) your explicit consent where required (e.g. WhatsApp notifications, marketing communications); (d) compliance with legal obligations under Turkish Law No. 6698 (KVKK) and other applicable laws.
We do not sell personal data. We share data only with:
Some sub-processors (e.g. Sentry DE, Google) may process data within the European Union. Transfers outside Türkiye are protected by standard contractual clauses or your explicit consent in line with KVKK Article 9.

We use only the cookies strictly necessary for the Service to function: a session cookie (HttpOnly, Secure, SameSite=Lax) and a CSRF token. No analytics, advertising or tracking cookies are set.
The Services are intended for business use by authorized hotel personnel and are not directed at children under 18.
We will notify you by email at least 30 days before material changes take effect.

Bu Gizlilik Politikası, Wholebeds RevenueOS platformunu ("Hizmetler") kullandığınızda BND Hospitality ("Wholebeds", "Biz") tarafından bilgilerin nasıl toplandığını, kullanıldığını ve korunduğunu açıklar.
Türkiye'de mukim BND Hospitality, platforma giriş yapan yetkili kullanıcılarınızın (yöneticiler, gelir müdürleri) kişisel verileri için veri sorumlusudur. Hizmetler aracılığıyla işlediğiniz otel misafirlerinize ait veriler için siz veri sorumlusu, Wholebeds ise veri işleyen sıfatıyla hareket eder.
İşleme şu hukuki dayanaklara dayanır: (a) sizinle Wholebeds arasındaki sözleşmenin ifası; (b) Hizmetlerin işletilmesi ve güvenliğine ilişkin meşru menfaatlerimiz; (c) gerektiğinde açık rızanız (örn. WhatsApp bildirimleri, pazarlama iletişimi); (d) 6698 sayılı Kişisel Verilerin Korunması Kanunu (KVKK) ve diğer yasalara uyum.
Kişisel verileri satmıyoruz. Verileri yalnızca şu taraflarla paylaşırız:
Bazı alt işleyiciler (örn. Sentry DE, Google) verileri Avrupa Birliği içinde işleyebilir. Türkiye dışına aktarımlar standart sözleşme hükümleri veya KVKK madde 9 kapsamında açık rızanız ile korunur.

Hizmetler, yetkili otel personelinin kurumsal kullanımı içindir; 18 yaş altı kişilere yönelik değildir.
Esaslı değişiklikleri en az 30 gün önceden e-posta ile bildiririz.

KVKK md. 5/2 (c) sözleşmenin kurulması/ifası, (ç) hukuki yükümlülük, (e) hak tesisi/korunması, (f) meşru menfaat. WhatsApp gibi opsiyonel kanallar için açık rıza alınır.
Veriler; barındırma, hata izleme (Sentry), uptime izleme ve iletişim (SMTP, Twilio) sağlayıcılarına aktarılabilir. Yurt dışı aktarımlar KVKK md. 9 kapsamında standart sözleşme hükümleri veya açık rıza ile gerçekleştirilir.
Veriler; web platformuna giriş, kullanıcı tarafından yapılan yüklemeler, otomatik veri çekim entegrasyonları (e-posta eki, Google Drive, OTA web sayfaları) ve sistem günlükleri aracılığıyla otomatik veya kısmen otomatik yollarla elektronik ortamda toplanır.
Veri sorumlusuna başvurarak; verilerinizin işlenip işlenmediğini öğrenme, işlenmişse bilgi talep etme, işlenme amacını ve buna uygun kullanılıp kullanılmadığını öğrenme, yurt içinde/dışında aktarıldığı üçüncü kişileri bilme, eksik/yanlış işlenmişse düzeltilmesini, KVKK md. 7'de öngörülen şartlar çerçevesinde silinmesini/yok edilmesini, düzeltme/silme/yok etme işlemlerinin aktarıldığı üçüncü kişilere bildirilmesini, münhasıran otomatik sistemlerle analiz edilmesi suretiyle aleyhine sonuç doğmasına itiraz etme ve kanuna aykırı işleme nedeniyle zarara uğramanız halinde zararın giderilmesini talep etme haklarına sahipsiniz.
